Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") are a legally binding agreement between you and Nation Network LLC, a Utah limited liability company ("Nation Network LLC", "we", "us", "our"), the operator of the Tatbook service ("Tatbook", the "Service"). By creating an account, accessing, or using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. About Tatbook

Tatbook is a software-as-a-service booking and management platform built for tattoo studios and independent artists. The Service includes online appointment scheduling, customer records, portfolio and flash-design hosting, subscription billing, payment processing via Stripe, outbound SMS via Telnyx, outbound email via Resend, and related tooling.

Nation Network LLC provides the platform software only. Shop owners who register for the Service (each a "Shop") are the merchants of record for appointments, deposits, and other transactions conducted through the Service. Nation Network LLC is not a party to the contract between a Shop and its customers and does not provide tattoo or cosmetic services. Nation Network LLC acts as a limited payment facilitator through Stripe Connect for the sole purpose of routing deposits and service fees to Shops.

3. Accounts and Eligibility

You must be at least 18 years old and able to form a binding contract to create an account. Account types include Shop Owner, Manager, Front Desk, and Artist. Owners register directly; Managers, Front Desk staff, and Artists may only access the Service through an invitation issued by a Shop Owner.

You must provide accurate, current information and keep it up to date. You are responsible for maintaining the confidentiality of your credentials, for all activity under your account, and for notifying us promptly at support@tatbook.app if you suspect unauthorized use. Account deletion is not self-service; contact support to request deletion.

4. Subscriptions, Fees, and Billing

The Service is offered on a subscription basis priced per Shop plan (Solo, Shop, or Studio), with a free trial on each new Shop. Subscription fees are billed in advance via Stripe. You authorize us to charge your payment method at the end of the trial period and on each subsequent renewal cycle until you cancel. You may cancel at any time from your account settings; cancellation takes effect at the end of the then-current billing period.

In addition to the subscription, the Service collects a booking fee on customer deposits processed through the platform. The rate depends on your Shop plan:

  • Solo (free) plan: 6% + $0.30 per transaction on customer deposits.
  • Shop plan: 4.9% + $0.30 per transaction on customer deposits.

These rates take effect for bookings made on or after July 20, 2026. Each fee is all-in: it covers Stripe's underlying card-processing cost and Tatbook's platform margin, with no separate platform fee. Deposits are paid out to your own connected Stripe account; Nation Network LLC does not hold your funds. All fees are stated in United States dollars and are exclusive of applicable taxes, which may be collected where required. Failed charges may result in suspension of access until payment is restored.

5. Theme Marketplace Purchases

Themes purchased through the Tatbook Theme Marketplace are licensed for use on Shop websites hosted by the Service. The licence is granted to the purchasing Shop only, is non-transferable, and does not convey ownership of the underlying source code, design files, or assets. Themes are not intended to function outside the Service and may not be exported, copied, redistributed, or deployed to any other platform.

Each premium theme is sold as an individually priced one-time purchase, not a subscription. Once a purchase is completed through Stripe Checkout, the Shop owns the theme for the lifetime of its account, subject to these Terms. Free themes are available to every Shop at no cost.

Theme purchases are final and non-refundable. Every theme can be previewed against the Shop’s real content from the Marketplace before purchase, which is the buyer’s opportunity to confirm the theme meets their needs. By clicking Continue to checkout in the purchase confirmation dialog, the Shop owner acknowledges and agrees to these Terms, including the no-refund policy.

Minor updates — bug fixes, accessibility improvements, security patches, and performance tweaks — are applied automatically to owned themes at no additional cost. Nation Network LLC reserves the right to retire, replace, or sunset themes at its discretion. No subscription plan includes themes; themes are always purchased individually and are not bundled with any plan tier.

6. Payment Processing via Stripe Connect

Payment processing on the Service is provided by Stripe Payments Company and its affiliates ("Stripe"). By accepting these Terms and registering a Shop, the Shop agrees to be bound by the Stripe Connected Account Agreement and the Stripe Services Agreement (together, the "Stripe Agreements"). Stripe may update its agreements from time to time; continued use of the Service constitutes acceptance of the current Stripe Agreements.

You authorize Nation Network LLC to register a Stripe Express Connect account in your Shop's name automatically when you create your Shop, pre-filled with your email and Shop name. The account is yours; Nation Network LLC does not hold your funds. To receive deposits, you must complete Stripe's identity and bank verification from the Payment Processor settings page. Until verification is complete, Stripe holds incoming deposits in escrow on your behalf and releases them when verification clears.

The Shop is solely responsible for the goods and services it offers through the Service, including but not limited to accuracy of pricing, fulfillment of bookings, compliance with applicable laws, customer communications, refunds, chargebacks, and dispute resolution. Nation Network LLC is not responsible for any customer dispute or for any liability arising from a Shop's services.

7. Customer Data Ownership

Each Shop is the data controller of personal data submitted by its customers through the Service (for example, customer names, phone numbers, appointment details, and any images customers upload). Nation Network LLC acts as a data processor on behalf of the Shop for this data. The Shop is responsible for the lawful collection and use of its customers' data, including obtaining any consents required under applicable law.

8. Acceptable Use

You agree not to use the Service to:

  • violate any law or regulation;
  • impersonate any person or misrepresent your affiliation with a person or entity;
  • upload or transmit material that is unlawful, infringing, defamatory, harassing, or otherwise objectionable;
  • transmit viruses, malware, or other harmful code;
  • reverse engineer, decompile, or attempt to derive source code of the Service, except to the extent such restriction is prohibited by law;
  • scrape, crawl, or automate access to the Service except through interfaces we expose for that purpose;
  • interfere with or disrupt the Service or the servers or networks connected to it.

We may suspend or terminate accounts that violate these rules.

9. User Content License

You retain ownership of the content you upload to the Service (including portfolio images, flash designs, service descriptions, and text you enter into your Shop). You grant Nation Network LLC a non-exclusive, worldwide, royalty-free license to host, store, cache, reproduce, process, transmit, and display your content solely as necessary to provide the Service to you and to your customers. This license terminates on removal of the content, except to the extent cached or backup copies remain for a reasonable retention period and except where retention is required by law.

10. Intellectual Property

The Service, including its software, design, and branding, is the property of Nation Network LLC and its licensors and is protected by copyright, trademark, and other laws. These Terms do not grant you any rights in the Service other than the limited right to use it in accordance with these Terms. You may not use our trademarks without prior written permission.

11. Termination and Suspension

You may cancel your subscription at any time from your account settings. We may suspend or terminate your access to the Service at our discretion if you materially breach these Terms, if your payment fails and remains unresolved, or if we are required to do so by law. On termination, your right to use the Service ends immediately. You may request an export of your Shop data within ninety (90) days after termination; after that period, your data may be permanently deleted in the ordinary course of business.

12. Warranty Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NATION NETWORK LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR FOR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM AND (B) ONE HUNDRED UNITED STATES DOLLARS (US$100.00).

14. Indemnification

You agree to defend, indemnify, and hold harmless Nation Network LLC, its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from (a) your use of and access to the Service; (b) your violation of any term of these Terms; (c) your violation of any third-party right, including any right of privacy or intellectual property rights; or (d) any claim that content you submitted caused damage to a third party.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service and update the "Last updated" date and version identifier at the top of this page. Your continued use of the Service after the effective date of the updated Terms constitutes acceptance of the updated Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally shall be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Utah, United States. You and Nation Network LLC each waive the right to a jury trial and agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. Nothing in this section prevents either party from seeking relief in small-claims court for claims that qualify.
